I. RIGHT OF APPLICATION OF THE DATA SUBJECT

• Scope of the Right of Application

Pursuant to Article 28 of the KVKK, data subjects cannot assert their rights in the following circumstances as these matters fall outside he scope of the KVKK:

(1) Processing of personal data for artistic, historical, literary, or scientific purposes or within the scope of freedom of expression, provided that such processing does not violate national defense, national security, public safety, public order, economic security, the privacy of private life, or personal rights, and does not constitute a crime.

(2) Processing of personal data for purposes such as research, planning, and statistics after being anonymized through official statistics.

(3) Processing of personal data within the scope of preventive, protective, and intelligence activities carried out by public institutions and organizations officially authorized by law to maintain national defense, national security, public safety, public order, or economic security.

(4) Processing of personal data by judicial authorities or execution organs regarding investigation, prosecution, adjudication, or execution proceedings.

Pursuant to Article 28/2 of the KVKK, data subjects cannot assert their rights (excluding the right to request compensation for damages) in the following cases:

(1) Where personal data processing is necessary for the prevention of a crime or for a criminal investigation.

(2) Where personal data processed has been made public by the data subject themselves.

(3) Where personal data processing is required for the performance of inspection or regulatory duties, or for disciplinary investigations or prosecutions by authorized public institutions, organizations, or professional organizations operating as public institutions, based on the authority granted by law.

(4) Where personal data processing is necessary for the protection of the economic and financial interests of the State with respect to budgetary, tax, and fiscal matters.

II. CONCLUDING THE APPLICATIONS

In accordance with Article 13 of the KVKK, if personal data subjects submit their requests regarding their personal data to us in writing (with a wet signature or an e-signature replacing a wet signature) or via other methods designated by the Personal Data Protection Board, our Company, acting as the Data Controller, will resolve the requests free of charge as soon as possible according to the nature of the request, and within thirty (30) days at the latest from the receipt of the request.

In order to ensure data security and prevent unauthorized disclosure, our Company reserves the right to request additional information or documentation from the applicant to verify whether they are indeed the owner of the personal data in question. Furthermore, clarification questions regarding the request may be directed to the data subject to ensure that the application is processed accurately.
